Over the past decade, there has been a dramatic increase in lawsuits against EMS providers and agencies.  High profile cases, such as the death of Elijah McClain, bring EMS providers and prehospital medicine into the spotlight.  Nick, an EMS Division Chief for one of the largest county-based ALS first response agencies in Georgia, and Samantha, an attorney for one of the largest hospital-based EMS systems in the Southeast, examine current legal hot topics for EMS.  Using actual incidents and reported legal cases, Nick and Samantha identify situations that are most likely to develop into litigation and offer practical strategies to help responders protect themselves and their services from legal liability.

Objectives:

  1. Identify and discuss areas of potential legal liability for EMS providers, including a focus on situations most likely to develop into litigation. 
  2. Describe factors that might impact immunity from lawsuits, including a focus on the role of bias and compassion fatigue in creating legal liability.
  3. Demonstrate practical strategies to limit potential liability from lawsuits, with a focus on the role of patient assessment and provider documentation.
